Kastner Kim LLP obtained a $3.5 million judgment in a shareholder derivative action in San Mateo County Superior Court involving claims for breach of fiduciary duty, interference with contract, interference with prospective economic advantage and unfair competition against a former director and his wife who misappropriated the company and its assets from the shareholders and setup a competing business for themselves. Attorneys Phil Martin and Ellie Schuermann argued the case on behalf of Plaintiffs in a ten day bench trial before the Honorable Gerald J. Buchwald in San Mateo County Superior Court with over 10 witnesses and 225 exhibits. Judge Buchwald issued a 45 page Statement of Decision finding in favor of the Plaintiffs against Defendants in the amount of $3.5 million, and awarding injunctive relief to redress the harm to competition caused by Defendants’ actions.
